Check before you sign
Renting in Ho Chi Minh City usually means a 1-year contract, a deposit (tiền cọc) of 1–2 months' rent, and rent paid monthly or several months in advance (trả trước). Terms differ from landlord to landlord, so read and negotiate before you sign.
- Notarization (công chứng) — under the 2023 Housing Law (Luật Nhà ở 2023), a lease does not have to be notarized. It must be a written contract, though, and you can notarize it if you want.
- Language — many contracts are bilingual (Vietnamese and English). Check which language prevails in a dispute.
- Early termination (chấm dứt trước hạn) — clauses where you lose your deposit (mất cọc) if you leave early are common.
- Temporary residence registration — this is the landlord's duty. You'll learn more in Lesson 3-4.

Real conversation — Negotiating contract terms
Minsu is about to rent an apartment on Quốc Hương Street, An Khánh ward, and is going through the contract with the landlord, Thanh. The rent is 15 million VND a month on a 1-year contract.

Contract checklist
- Landlord's identity — check that it's the owner and that the name matches the ownership certificate (sổ hồng). If it's a representative, ask to see the power of attorney.
- Amounts in figures and words — check the contract has both 15.000.000 đồng and 'mười lăm triệu đồng'.
- What's included — write the management fee (phí quản lý), internet, parking and the electricity and water rates into the contract.
- Record the condition on move-in — on moving day, take photos and videos of the walls, furniture and appliances and send them to the landlord on Zalo to avoid disputes when you move out.
- Notarization isn't required, but for large amounts or if you're unsure, you can have it done at a notary office (văn phòng công chứng).
Common deposit disputes
- Verbal promises may not be kept. Always put what you negotiated into the contract.
- When you move out, landlords often cut the deposit for 'dirty walls', 'cleaning fees' and so on. Move-in photos are your strongest evidence.
- Pay the deposit and rent by bank transfer and keep the records. If you pay cash, always get a receipt (biên nhận).
- Being asked to send a deposit before you've even seen the place may be a scam.
